Estate Planning & Probate
Estate Planning is the process of proactively preserving an individual’s assets, allowing them to control their property and healthcare decisions during and after life. This process often encompasses the drafting of legal instruments such as a will, power of attorney (financial or healthcare), trusts, and other documents that memorialize administrative directives and beneficiary designations. Probate is the legal/ administrative process of settling an estate after someone dies. To start the process, a petition must be filed with the appropriate court, in which the court would appoint an executor/ administrator depending on if the deceased had a will.
